Last Updated: November 10, 2024

Prosperous Ventures, LLC (“we,” “our,” or “us”) respects the intellectual property rights of others and is committed to complying with the Digital Millennium Copyright Act (“DMCA”). This DMCA Policy explains how we address copyright infringement claims on our website, FrederickDudek.com (the “Site”), and outlines the procedures for notifying us of alleged infringements.

1. Reporting Copyright Infringement

If you believe your copyrighted material has been posted, shared, or otherwise made accessible on FrederickDudek.com without authorization, please submit a DMCA notice to us, ensuring it includes the following:

Identification of the copyrighted work you claim has been infringed. Please be specific and include details such as the work’s title, publication date, and, if available, a registration number.

Identification of the infringing material on our Site, with a URL link or other sufficient detail to allow us to locate the material. The clearer and more specific the information, the faster we can investigate.

Your contact information, including your full name, address, telephone number, and email address.

A statement of good faith belief that the use of the material is unauthorized by you, your agent, or the law.

A statement declaring that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the copyright owner.

Your physical or electronic signature or the signature of your authorized representative.

2. Counter-Notification Process

If you believe that material posted on the Site was wrongly removed or disabled based on a DMCA Notice, you may submit a counter-notification. The counter-notification should include:

Identification of the removed material or the location where it appeared before removal or access was disabled.

A statement under penalty of perjury that you believe in good faith that the material was removed or disabled due to a mistake or misidentification.

Your contact information, including your full name, address, telephone number, and email address.

A statement consenting to the jurisdiction of the federal court in your judicial district (or in [Your Business Location] if outside the United States) and agreeing to accept service of process from the original claimant or an agent.

Your physical or electronic signature or the signature of your authorized representative.

Upon receiving a valid counter-notification, we may restore the removed content unless the original claimant files a legal action seeking a court order to keep the material removed.

3. Automated Systems, Bots, and Fraudulent Notices

Our Site may use automated systems, bots, and other technologies to monitor content for copyright compliance and respond to copyright claims. While these systems are intended to improve efficiency, they are not infallible. We have protocols in place to review claims manually, and we do not rely solely on automated systems to assess or take action on claims.

a. Abuse of the DMCA Process: We take DMCA abuse seriously. Fraudulent or baseless DMCA notices will not be tolerated. Submitting a false DMCA notice, or counter-notice may result in legal consequences, including liability for damages, costs, and attorneys’ fees.

b. Repeat Infringers: We reserve the right to terminate user accounts and block IP addresses of users who are identified as repeat infringers of copyright or who repeatedly submit fraudulent claims.

c. Protecting Legitimate Content: We aim to balance the protection of copyright with the rights of our users to post content. If a claim is determined to be fraudulent or abusive, we reserve the right to restore content and take appropriate action against the abusive claimant, including banning them from the Site.

4. Limitations of Liability and Modifications

Prosperous Ventures, LLC is not responsible for content posted by users or third parties. We will make every effort to respond promptly to all valid DMCA notices and counter-notifications, but we cannot guarantee that every request will be fulfilled within a specified timeframe. We reserve the right to modify this DMCA Policy at any time without prior notice.
